Why does this game not seem to care about nintendo's DMCA takedowns on fan games?

I always wondered why, since nintendo seems to love taking down fan games, whether they effect them or not.
We have an extremely strict policy regarding advertising. Beyond completely unsolicited donations (which don't get you anything in return), we do not make money from anything. That and Mari0 hasn't been at peak popularity for quite some time, which keeps it under the radar.
And Super Mario Maker is definitely a ripoff of Mari0 so I'm sure they're the ones afraid of us.
