What is the license after all?

The license header in the sourcecode is a bit confusing, if it's no rights reserved how can you have the right to demand attribution, non-comercial usage only, that people don't remove the license header etc?

Maurice wants us to stick to the Creative Commons License [Attribution, Non-Commercial, Share Alike] by default. (unless HE TELL YOU PERSONALLY, that you can waive these restrictions or totally ignore the CCL)
In fact, from Nintendo's and Valve's point of view (and any of their employees, including one of my friends), this license is invalid as Mario is pure trademark of Nintendo, as Portal - of Vavle. And in another fact, even Nintendo won't care about this, because the game is true fan fiction. Which, however cannot stop Nintendo from making money out of it (Which they already do as this game is one HUGE advertisement of both Portal AND Mario).
The current realization, the game Mari0, the game itself - some of the artwork, and all of the code Maurice wrote himself, is this that Maurice owns (as an author). This, however, excludes the NES' SMB tileset, as it is pure rip off the NES cartridges, and which copyright holders are still and always will be, Nintendo. About the modded Mario sprite with the portal gun, the case is more strange, as it is derivative work of the original Nintendo's sprite. Which, because of this sprite's original license, still belongs to Nintendo...
About share-alike clause, it is a must. :)
Also, Maurice is probably not a lawyer, non he want to pay one, so such licensing "bugs" can always occur. If you don't like CCL-BY-NC-SA and want to use its source code in non-CCL ways, ask him. Don't eat it's header, better go to Subway and eat a fresh sandwich :) [sorry for the ad] :D because else Nintendo will eat fresh developer meat someday... :D

I have both Linux And Windows.
Windows 7 at home, Ubuntu 11.10 at work.
I cannot test Mari0 on that Linux, however, because of stupid integrated Intel card... and lack of good support for the Love2D engine and these integrated cards on Linux.
A friend of mine have both ubuntu and Windows 7 on his PC, the game works perfectly over there :)

Here's the basic summary:
He doesn't give a shit what you do with it as long as you don't claim you made it. I would say 'no making profits out of it' too, but YouTubers doing Let's Plays of it already are making money out of it. Not sure where the legality is here, as it's still advertising for Mario and Portal, but not really that much as the game itself is a copyright breach of sorts.

Please do not use "No Rights Reserved" incorrectly as that implies public domain. If you mean "Some rights reserved" as that implies Creative Commons or other copyleft license, then say "Some rights reserved." It's confusing enough without developers who ought to know better using the wrong terms
